1. Definitions

  • Client — the person, firm or company who purchases services from Hackwood Electrical.

  • Contract — the agreement between Hackwood Electrical and the Client for the provision of services.

  • Works — the services, materials and deliverables set out in the quotation, proposal or order confirmation.

2. Applicability & Acceptance

These Terms & Conditions apply to all quotes, estimates and contracts for works carried out by Hackwood Electrical. Acceptance of a quotation, instruction to proceed, payment of a deposit, or allowing Hackwood Electrical to attend site shall constitute acceptance of these terms.

3. Quotations & Validity

Quotes are valid for 30 days from issue unless otherwise stated. Quotations are based on the information available at the time of pricing; additional or unforeseen works may incur extra charges and will be agreed in writing before proceeding.

Material costs: All material costs include a percentage markup covering transport, selection, and any remedial costs.

4. Deposit & Booking

A 30% deposit of the quoted contract sum is payable to secure the booking and order materials. The deposit will be deducted from the final invoice. If the Client cancels the booking within the timeframes set out in clause 7, the deposit may be retained to cover reasonable losses and costs incurred.

5. Minimum Call-Out Fee

A minimum call-out charge of £100 applies to all service visits unless otherwise stated in writing.

6. Out‑of‑Hours Work

Out-of-hours rates apply for work carried out:

  • Weekdays: 16:30 — 08:30

  • Weekends: All day Saturday and Sunday
    Out-of-hours rates will be confirmed in writing before the works begin.

7. Cancellation & Amendments

All cancellations within 48 hours of the scheduled start of works will incur charges as follows:

  • Single‑day projects: Cancellation within 48 hours of the scheduled start will incur a £120 cancellation fee.

  • Multi‑day projects: Cancellation within 48 hours of the scheduled start will incur 25% of the total quoted value.

If the Client requests amendments to scheduled works, we will use reasonable endeavours to accommodate changes but reserve the right to adjust the price and timescale.

8. Site Readiness & Third‑Party Delays

Hackwood Electrical will attend site on the agreed date and time. It is the responsibility of the Client and/or third parties (e.g. other contractors, suppliers or site managers) to ensure the site is ready and in a suitable condition for the agreed works to proceed.

If, on arrival, Hackwood Electrical cannot carry out the agreed works due to factors outside our control (for example: site not ready, access unavailable, other trades causing obstruction, or required preparatory works incomplete), we reserve the right to charge for lost time and costs.

Charges for lost time / abortive attendance: based on our standard day rate of £350 + VAT per electrician, multiplied by the number of team members who were due to be on site. Charges will be applied in either half-day or full-day units only — no pro‑rata hourly calculations. These charges are payable under the standard payment terms in clause 10.

9. Materials, Suppliers & Retention of Title

Where materials are supplied by Hackwood Electrical, ownership of those materials remains with Hackwood Electrical until full payment has been received (a retention of title).

Material costs include a percentage markup covering the cost of transport, selection and any remedial costs.

The Client must provide safe and secure storage for materials on site unless we are pre-warned and alternative arrangements are agreed. Hackwood Electrical will not be liable for materials damaged or stolen if secure storage has not been provided as agreed.

All prices are exclusive of VAT unless stated otherwise. Final invoices are due for payment within 7 days of completion of the works unless agreed otherwise in writing.

Late payment:

  • For commercial (B2B) clients: statutory interest (8% plus Bank of England base rate) and fixed sums for recovery costs (as set by late payment legislation) may be charged where applicable.

  • For consumer (B2C) clients: a £40 administration fee will apply to amounts under £1,000 and the Client will be liable for reasonable debt recovery costs; we will apply interest only where reasonable and in line with consumer protection rules.

11. Warranty & Standards

We provide a 12‑month warranty on labour and supplied materials from the date of completion, subject to normal wear and tear and excluding defects caused by misuse, alterations by third parties, or events outside our control.

Where statutory or industry standards apply, works will be carried out in compliance with relevant regulations.

12. Liability, Insurance & RAMS

We maintain public liability insurance to a level of £2 million (subject to confirmation of current policy limits). We also maintain professional indemnity insurance to a level of £250,000. Evidence of cover can be provided on request.

We can provide Risk Assessments and Method Statements (RAMS) for our works, but must be notified in advance if these are required.

Limitation of liability:
Except where prohibited by law (for example death or personal injury caused by our negligence; fraud), Hackwood Electrical’s total liability to the Client for any loss, damage or claim arising out of or in connection with the contract shall be limited to the total price paid under the contract. Any other limitation of liability shall be reasonable and subject to applicable law.

13. Health & Safety / Access

The Client must ensure safe access to the site, provide any required permits and notify Hackwood Electrical of site hazards. We reserve the right to refuse to work in unsafe conditions.

14. Subcontracting

All subcontractors engaged by Hackwood Electrical will be contracted by Hackwood Electrical, will fall under our control, and we remain fully responsible for their performance and conduct.

We act as data controller for the personal data we collect to perform the contract. We process only the personal data necessary to provide the services. We will not share personal data with third parties except where necessary to perform the contract or as required by law. 16. Force Majeure

We are not liable for failure or delay in performing obligations caused by circumstances beyond our reasonable control (including extreme weather, strikes, supplier failure, or other unforeseen events). If a delay continues for more than 28 days, either party may terminate with written notice.

17. Consumer Specific Notes

Where the Client is a consumer (a person acting outside their trade, business or profession), the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 may apply. Consumers generally have a 14‑day cooling‑off right for contracts agreed at a distance (e.g. online, over the phone, or at the consumer’s home).

Important: This statutory 14‑day right does not apply to contracts agreed entirely on business premises (e.g. where you meet at our office/site and contract is signed there).

If the consumer asks Hackwood Electrical to begin work during the 14‑day period, they may be charged for the value of the services performed up to the point of cancellation. If the works are completed in full within the 14‑day period, the right to cancel is lost.

This statutory cooling‑off right sits separately to Hackwood Electrical’s 48‑hour cancellation policy (see clause 7). The 48‑hour policy applies to all clients once works have been scheduled and booked, regardless of whether statutory cooling‑off rights apply.

We will provide the required pre‑contract information and the model cancellation form where the CCRs require them to be supplied with off‑premises or distance consumer contracts.

18. Dispute Resolution

We aim to resolve disputes informally in the first instance. We are registered with NAPIT and unresolved complaints may be escalated to NAPIT’s complaints procedure where applicable.

19. Entire Agreement & Governing Law

These terms constitute the entire agreement between the parties. These terms and any contract to which they apply shall be governed by and construed in accordance with the laws of England & Wales and the parties submit to the exclusive jurisdiction of the English courts.
